Hi everyone my name is Allison Grosz, I’m an attorney and a partner with Hemrick O’Malley PLLC. here in New York City.
Today I want to talk about a relatively recent and yet older update from the Department of Homeland Security that is now being officially codified in the federal register. Recently USCIS and the Department of Homeland Security announced that they will make a permanent fixture of the automatic 540-day employment authorization extension so let’s talk about what this is.
A long while ago DHS implemented a temporary policy at that period of time where it said that anyone who has a current work authorization or employment authorization document based on a pending application for legal status in the United States or based on having legal status in the United States, if that person has an expiration date coming up for their employment authorization and they timely meaning before the expiration file a renewal application of the employment authorization document then they would get an automatic 540-day extension of their employment authorization.
Now as I said this was a temporary fixture that was announced by the Department of Homeland Security quite some time ago however DHS just announced that they are going to make this a permanent fixture by codifying it in the Federal Registera. What this means is that the 540-day extension for people who timely file to extend their employment authorization documents meaning they file it before the expiration of their current employment authorization documents will permanently get that 540 day extension this is going
to help a lot of people especially because we are anticipating that processing times may increase in the coming months due to the new Administration coming in which is just a normal part of any typical administrative change process so with that being said we here at Hemrick O’Malley PLLC. of course renew people’s work authorizations every day.
